Terms of Service

These Terms of Service (“Terms”) govern your access to and use of trysellkit.com and the Sell Kit application (the “Service”), provided by EIKO Consulting, LLC, a Virginia limited liability company doing business as hello EIKO (“hello EIKO,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Beta Status

Sell Kit is currently in beta. This means:

  • The Service may have bugs, incomplete features, or unexpected behavior.
  • Features may change, be removed, or be replaced without notice.
  • We make no guarantees about availability, uptime, or data durability during the beta period.
  • Beta access may be revoked at our discretion.

We’ll do our best to keep things working and to communicate significant changes, but beta is beta.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal authority to agree to these Terms on your own behalf or on behalf of an organization.

3. Account Registration

To use Sell Kit, you may need to create an account. You are responsible for:

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Notifying us promptly at support@trysellkit.com if you suspect unauthorized access

We reserve the right to terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Harass, threaten, or harm others
  • Scrape, reverse-engineer, or attempt to extract the Service’s underlying code or data
  • Generate spam, phishing content, or deceptive materials
  • Infringe the intellectual property rights of others
  • Interfere with or disrupt the Service’s infrastructure

The AI tools in Sell Kit are designed to assist with legitimate sales communication. Using them to generate misleading, fraudulent, or deceptive content is prohibited.

5. Your Content

You retain ownership of the content you create or upload through the Service (your writing samples, prospect notes, email drafts, etc.). By using the Service, you grant hello EIKO a limited license to process that content solely to provide and improve the Service.

You are responsible for ensuring that any content you submit does not violate the rights of others or applicable law.

6. AI-Generated Output

Sell Kit uses AI to generate output based on your inputs. You are responsible for reviewing any AI-generated content before using it. hello EIKO does not guarantee that AI-generated output is accurate, appropriate, or suitable for any particular purpose. AI can make mistakes. Use your judgment.

7. Intellectual Property

The Sell Kit name, logo, and all Service content (excluding your content) are the property of EIKO Consulting, LLC. Nothing in these Terms grants you a license to use our trademarks or branding.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, hello EIKO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed $100.

10. Indemnification

You agree to indemnify and hold hello EIKO and its officers, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. You may stop using the Service at any time. Sections 5, 8, 9, 10, and 12 survive termination.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Alexandria, Virginia, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll update the “Last Updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
